Guardianship of a Minor

When determining whether to represent yourself in a minor guardianship action, you must first determine whether your case will be contested or uncontested by the child's biological parents, if they are alive.  The most common type of minor guardianship occurs in a child's grandparents when the child's biological parents are unable to carry out their parental responsibilities.

What is Guardianship?

A guardian is someone who is appointed by a court to protect and care for the health and well-being of an incapacitated person, or a minor child. A petition must be filed with the appropriate court, and notice given to all interested persons. The process may be complicated, so you are advised to consult with an attorney.
